THE SYSTEM OF PUBLIC ADMINISTRATION ENTITIES RESPONSIBLE FOR INTERAGENCY COOPERATION AMONG LAW ENFORCEMENT AGENCIES IN UKRAINE

Abstract

The article is devoted to the theoretical and legal substantiation of the system of
public administration entities involved in interagency cooperation among law
enforcement agencies in Ukraine. The concept of a public administration entity is
examined with due regard to the institutional, competence-based, and functional
components of its legal status. The expediency of applying a broad functional approach
is substantiated, according to which the system under study includes not only law
enforcement agencies directly engaged in joint activities, but also public authorities,
structural units, and officials vested with powers in the areas of strategic planning,
regulatory framework development, general administration, special coordination,
organizational and information-analytical support, and oversight.
The distinctions between a public administration entity responsible for
interagency cooperation and a direct participant in a specific joint activity are identified.
The relationship between cooperation, coordination, administration, and control is
analysed, with particular emphasis on the organizational autonomy of law enforcement
agencies and the inadmissibility of one authority substituting for the competence of
another. The powers of entities performing strategic, managerial, coordination,
executive, support, and control functions are also examined.
An original classification is proposed, encompassing entities responsible for the
strategic and regulatory determination of the foundations of cooperation, entities of
general managerial competence, entities of special coordination competence, entities
directly engaged in law enforcement cooperation, entities providing organizational and
information-analytical support, as well as entities responsible for control and
performance evaluation. It is established that the system of the relevant entities is
multilevel and dynamic, combines vertical, horizontal, and diagonal relationships, and
varies depending on the subject matter and area of a particular form of cooperation. The
article identifies directions for improving the regulatory framework, including the
unification of the principles of interagency cooperation, clarification of the competence
of its entities, development of information-exchange procedures, and improvement of
mechanisms for monitoring the implementation of joint decisions.
