MODERNIZATION OF LEGAL REGULATION OF THE PUBLIC ADMINISTRATION SYSTEM IN THE CONTEXT OF POST-WAR TRANSFORMATION

Abstract

The article examines the theoretical and practical aspects of
modernization of legal regulation of the public administration system of Ukraine in the
context of the completion of the armed conflict and transition to the stage of post-war
state transformation. The author analyzes the current state of the regulatory framework in
the field of public administration, identifies systemic deficiencies of existing legislation
that complicate the processes of restoration and reconstruction of the institutional
architecture of the state. The necessity of comprehensive reform of legal mechanisms of
public administration is substantiated, taking into account EU standards, requirements of
the European integration process, and the specifics of rebuilding affected regions. Special
attention is paid to the legal support of power decentralization, modernization of civil
service, and improvement of civil society institutions as key components of an effective
public administration system in conditions of transformational transition. The foreign
experience of legal regulation of state recovery processes after armed conflicts, in
particular, the experience of the Republic of Kosovo, Georgia and Bosnia and
Herzegovina, is examined. Based on a comparative analysis, the author proposes a
concept for modernizing the legal regulation of public administration, which envisages
the introduction of new legal instruments for managing reconstruction, digital
transformation of public authorities, strengthening anti-corruption mechanisms, and
reinforcing the rule of law. Specific proposals for improving legislation in the field of
public administration are formulated, and priority areas for further research in this field
are identified.
