BRINGING THE WASTE DISPOSAL SITE INTO COMPLIANCE WITH LEGAL REQUIREMENTS

The article was prepared in connection with the adoption of the Law of
Ukraine «On Waste Management» and is aimed at the topical issue of establishing
uniform requirements for the rules of bringing waste disposal sites into compliance
with the requirements of the law. The article describes the requirements for a plan
to bring a waste disposal site into compliance with the requirements of the law.
These requirements relate to the planning of activities of business entities,
regardless of their form of ownership and organisational and legal forms of
management of waste disposal sites, such as landfills or dumpsites, throughout
their life cycle.
The Conversion Plan of waste disposal sites in accordance with the
requirements of the law must be developed by identifying measures, their deadlines
and a feasibility study to bring the waste disposal site into compliance with the
capacity of the waste disposal site for a certain period of its lifetime. The Plan
must be developed by the waste disposal site operator and submitted to the
Ministry of Environment for obtaining a permit. The structure of the plan is drawn
up in accordance with the requirements and should include: a description of the
waste disposal site, an analysis of the current state of the waste disposal site, and
planning of measures to bring the disposal site into compliance with the
requirements of the law. Such measures are aimed at developing design and
technical documentation, re-equipment, repair, modernisation, reconstruction or
construction, improving the efficiency of waste treatment, improving the quality
and scope of services and purchasing works, goods and services aimed at
renewing fixed assets. On an annual basis, the operator of a waste disposal site
publishes information on the results of the plan implementation on its official
website. The implementation of the Compliance Plan must be checked by the
territorial body of the State Environmental Inspectorate.
The author proposes the structure of the plan itself and recommended
measures with the conditions for their application.
